El contratista y el entonces alcalde hab\u00edan autorizado el desplazamiento sin cumplir con los protocolos m\u00ednimos de seguridad.<br \/><br \/>En segunda instancia, el tribunal modific\u00f3 la decisi\u00f3n inicial y elev\u00f3 la responsabilidad del municipio de un 10\u202f% a un 20\u202f%, al comprobarse una omisi\u00f3n institucional grave en la supervisi\u00f3n del contrato. El contratista asumir\u00e1 el 30\u202f% y se mantuvo un 50\u202f% de responsabilidad atribuida a la conducta imprudente de la propia v\u00edctima.<br \/><br \/>El fallo obliga al pago de perjuicios morales, pero niega indemnizaci\u00f3n por lucro cesante al no presentarse pruebas suficientes. La decisi\u00f3n sienta un precedente sobre el deber de vigilancia estatal en la ejecuci\u00f3n de obras p\u00fablicas.<\/span><\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section
