El Tribunal Administrativo de Boyac\u00e1 absolvi\u00f3 al ICBF en un caso relacionado con la muerte de un maestro de obra durante reparaciones en un inmueble de su propiedad en Moniquir\u00e1. La decisi\u00f3n se bas\u00f3 en la falta de pruebas que demostraran un v\u00ednculo entre la entidad, el contratista y el trabajador fallecido.

El Instituto Colombiano de Bienestar Familiar (ICBF) fue absuelto de responsabilidad por la muerte de un obrero que realizaba reparaciones locativas en un inmueble de su propiedad en el municipio de Moniquir\u00e1, Boyac\u00e1. As\u00ed lo determin\u00f3 el Tribunal Administrativo del departamento, al concluir que no se prob\u00f3 el nexo causal ni jur\u00eddico entre la entidad, el contratista y la v\u00edctima.

Aunque en primera instancia se reconoci\u00f3 el da\u00f1o \u2013la muerte del trabajador\u2013, el tribunal aclar\u00f3 que la parte demandante no logr\u00f3 acreditar la existencia de una relaci\u00f3n contractual o legal entre el ICBF y el contratista que ejecutaba las obras. Adem\u00e1s, se comprob\u00f3 que la persona que firm\u00f3 el contrato de obra con el fallecido no era la representante legal de la asociaci\u00f3n de padres encargada del hogar infantil.

Seg\u00fan el fallo, la Asociaci\u00f3n de Padres del Hogar Infantil de Moniquir\u00e1 deb\u00eda solicitar autorizaci\u00f3n al ICBF para realizar cualquier reparaci\u00f3n en el inmueble, lo cual no ocurri\u00f3. El tribunal concluy\u00f3 que la entidad desconoc\u00eda las obras y que no exist\u00eda obligaci\u00f3n jur\u00eddica de su parte que justificara una imputaci\u00f3n.

En consecuencia, al no existir v\u00ednculo ni responsabilidad directa, el tribunal declar\u00f3 que el ICBF no incurri\u00f3 en falla del servicio ni tuvo parte en el hecho que ocasion\u00f3 el da\u00f1o.<\/span><\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t
