Durante su traslado a Saravena para ser entregado a su madre, tres hombres interceptaron el veh\u00edculo y lo raptaron. Desde entonces se desconoce su paradero.<br \/><br \/>El tribunal determin\u00f3 que ni el Ej\u00e9rcito ni el comisario de familia incurrieron en negligencia. El menor fue entregado en condiciones adecuadas y el funcionario actu\u00f3 dentro de sus competencias al trasladarlo ante la ausencia de alternativas institucionales de protecci\u00f3n.<br \/><br \/>La sentencia tambi\u00e9n se\u00f1ala que la madre del menor desatendi\u00f3 los llamados oficiales para recibirlo, lo cual agrav\u00f3 el riesgo. En consecuencia, el tribunal concluy\u00f3 que no existi\u00f3 una falla del servicio ni una omisi\u00f3n imputable al Estado.<br \/><br \/>Un magistrado salv\u00f3 su voto, argumentando que el Estado ten\u00eda una posici\u00f3n de garante y que la desaparici\u00f3n del menor, al estar bajo su custodia, s\u00ed configuraba un da\u00f1o antijur\u00eddico. Aun as\u00ed, su postura no prosper\u00f3 en la decisi\u00f3n final.<\/span><\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section
