Sostuvo que, por orden legal, era ella quien deb\u00eda asumir el cargo, al ser la siguiente en la lista del partido.<br \/><br \/>Aunque en primera instancia sus pretensiones fueron negadas, el Tribunal revoc\u00f3 la decisi\u00f3n al concluir que la Asamblea desconoci\u00f3 el orden constitucional de reemplazo por lista, priorizando una evaluaci\u00f3n sobre su militancia partidista que no ten\u00eda sustento jur\u00eddico.<br \/><br \/>El fallo declar\u00f3 nulos los actos administrativos y orden\u00f3 el pago total de los salarios y prestaciones dejados de percibir durante el periodo en el que la demandante debi\u00f3 ejercer como diputada, al no existir prueba de inhabilidad ni doble militancia en su contra.<br \/><br \/>Un precedente claro: la ley obliga a respetar el orden de votaci\u00f3n y no deja margen a decisiones
